1. About Treiva

Treiva Ltd (Company Number: 16119439), registered at Co Chandler And Partners, Britannia Court, 5 Moor Street, Worcester, Worcestershire, England, WR1 3DB (“Treiva”, “we”, “us”, “our”) provides AI-powered sales assistant services to help businesses manage, qualify, and nurture leads.

2. Acceptance of Terms

By subscribing to Treiva, accessing our services, or using our AI agent, you (“Client”, “you”, “your”) agree to these Terms of Service. If you do not agree, do not use Treiva.

3. Our Services

We provide:

● An AI agent that handles inbound enquiries, chats with website visitors, prospects databases, and books appointments on your behalf.

● Integrations with communication channels (e.g., WhatsApp, Messenger, SMS, email).

● Access to our dashboard for lead management and reporting.

We may update or improve the services from time to time.

4. Your Responsibilities

You agree to:

● Use Treiva only for lawful purposes and in compliance with all applicable laws.

● Not use Treiva to send spam, unsolicited messages, or illegal content.

● Provide accurate business information when onboarding and keep credentials secure.

● Obtain all necessary consents for processing your leads’ personal data via Treiva.

5. Data Protection

● You act as the Data Controller, and Treiva acts as a Data Processor for any personal data processed through our services.

● We process data in accordance with our Privacy Policy and your Data Processing Agreement (DPA).

● You must comply with all applicable data protection laws, including GDPR where relevant.

6. Subscription, Fees & Payment

● Access to Treiva is provided on a subscription basis.

● Fees are payable monthly or annually in advance, as set out in your plan.

● Late payments may result in suspension of your account.

● All fees are exclusive of VAT or other taxes unless stated otherwise.

7. Intellectual Property

● Treiva retains all intellectual property rights in the AI technology, dashboard, and related services.

● You retain ownership of your own business data.

● You grant us a non-exclusive right to process your data solely to provide the services.

8. Confidentiality

Both parties agree to keep confidential any non-public information obtained from each other and not disclose it to third parties, except as required by law.

9. Limitation of Liability

● Treiva provides the services “as is” and does not guarantee uninterrupted or error-free operation.

● To the maximum extent permitted by law, Treiva’s total liability to you for any claim under these Terms shall be limited to the amount paid by you to Treiva in the 12 months preceding the claim.

● Treiva shall not be liable for indirect, incidental, or consequential losses.

10. Termination

● You may cancel your subscription at any time, subject to any agreed notice period.

● We may suspend or terminate your access if you materially breach these Terms or applicable law.

● Upon termination, your right to use Treiva immediately stops, but relevant sections (e.g., confidentiality, liability) will continue.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.

12. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated to you in advance. Continued use of Treiva means you accept the updated Terms.
